Terms of Service

These Terms of Service ("Terms") govern your use of Ella.ai, a product of Hankified LLC ("we," "us"), New York. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

Ella is an AI companion for clarity, reflection, building momentum, and self-discovery — across seven conversation modes, Brain memory, Tools, and Insights. Ella is not a medical device, therapist, crisis hotline, or emergency service.

• You must be at least 18 years old
• You must provide accurate registration information
• You are responsible for activity under your account

You agree not to:

• Use Ella for illegal activity, harassment, or impersonation
• Attempt to bypass message limits, scrape the Service, or reverse-engineer systems
• Upload malware or content that violates others' rights
• Use the Service to provide unauthorized clinical or emergency care to third parties

You retain ownership of content you submit. You grant us a limited license to host, process, and display it solely to operate Ella.ai (including sending messages to AI providers for responses).

• Responses are generated by AI and may be inaccurate or incomplete
• Ella does not provide medical, legal, financial, or professional advice
• You are responsible for decisions you make based on conversations

Free Forever includes 7 messages per day (UTC). Paid plans increase limits and Brain memory as described on /pricing. We may enforce fair use on paid tiers to protect service quality.

• Paid plans bill through Stripe; subscriptions renew until cancelled
• Cancel anytime via account settings or Stripe customer portal; access continues through the paid period
• Refunds are generally not provided for partial periods except where required by law or at our discretion
• Price changes require advance notice before your next renewal

You may delete your account at any time in Settings → Account data. Deletion cancels active subscriptions, removes your Ella data from our systems, and closes your login. We may suspend or terminate accounts that violate these Terms or pose risk to the Service or others.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELLA.AI AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in New York, except where prohibited. You may also have mandatory consumer rights in your jurisdiction.

We may modify these Terms. We will post updates with a revised date. Material changes may be notified by email or in-product notice.
